It's a bit of a grey area regarding clearance, stretched tyres ect ect, but I believe, legally, the tyres tread must be covered by the arch, it's to do with the possibility of objects being flicked up with no arch to catch them and causing possible injury to passers by, hitting other vehicles. Of course it would depend on the situation if ever it was queried, what the officers knowledge of the laws on tyre protrusion are, if vosa got hold of it then probably would be a bigger issue.

If the wheels extend past the arches it is only an advisory on the mot, but under the road traffic act/ construction and use guidelines the police can/will do you for it
