I was checking the front end after our little outing last weekend and I noticed my nearside front rim is coming into contact with the steering arm behind the axle when on full right hand lock. The offside doesn't do this. So what I am thinking is I can ignore it or maybe fit wheel spacers. I took a wheel nut off to see how much stud is available and it's a choice of 5mm max or stick the 32mm spacers on. As I have modular wheels on already will sticking 32mm be too much for the bearings to cope with? What do you guys think?

If it only catches on full lock I wouldn't worry about it too much, you could try 5mm spacer if you want but 32mm might be too big.

If its road legal and goes for an mot with them wheels on it will/should fail

Fit some washers over the studs till it justs clears then mesure the washers and buy a spacer to suit

This is odd. Is there any evidence of the steering arm having been taken off the steering box. I wonder if it has not been put back on in the right place with the steering box in the dead ahead position, so you have more lock one way than the other. The only thing that stops the steering is the reach the box allows it. There are no steering stops like on a landrover.

There is a maximum the swivel will go but it is more than the box will allow normally, hence my suspicion above.

I can't think it will be due to the wrong wheel offset unless they are quite wide modulars as they would foul on the brake caliper first.

I think you should be able to fix it without spacers but as Mark says, it needs sorting. Spacers will stop the rubbing happening but not really solve the problem over all.
