The swivel bearings/kingpins are gone on the passenger side, which is why there is an oil leak, and may explain that creaking sound. This will be a fail if he can detect any movement (lack of use will be your friend here)
If it suddenly breaks, go back to the last thing that you did before it broke and start looking there

(Depends on the tester)

Both v helpful replies thanks gents.
It's going to the garage Tomo for the window mech and horn to be sorted so I'll get him to clean it up and make it look more presentable. Are rusty disks just an advisory then?
I'll do the kingpins in time but hopefully will pass the mot as it is for now.
It's booked for Monday so nervous times!
When you say lack of use is my friend how do you mean? It's done about 30 miles since its last mot so hopefully there shouldn't be anymore movement than before!

The brakes will fail on efficiency or balance if the disc is so rusty as to not be working.
Discs fail if they are weakened by corrosion or insecure.
A corroded or missing backplate is a fail, but that is just a dust shield, a backplate has mechanical components attached .
If the bearings are full of rust, they will be tight. As you use the car, the rust grinds down and the bearing gets loose.
The tester will pay more attention to the one showing signs of oil leakage if he knows his stuff.
It is always a good idea to wirebrush off a bit of the loose rust and make it look as though the car has been serviced/looked after.

On my Jimny the offside hub looks like this- is that the brake sensor attached? I'm not v mechanical ha! My new W reg obvs doesn't have this as the whole dust cover is missing
It's in for welding on sat so I'll get him to crack on with the wire brush and smarten it all up- hopefully a clean up of the hub will help hide the issue for now! I'll get a kingpin ordered up in case it does fail though!
